Court to rule on NDC congress injunction Thursday

The Accra High Court yesterday adjourned to December 18, 2014 the hearing of an application for an interlocutory injunction on the pending congress of the National Democratic Congress (NDC).

The Member of Parliament (MP) for Afram Plains, Mr Emmanuel Aboagye Didiaye, who is also a national organiser aspirant, went to court for what he described as an orchestrated attempt to disqualify him from the contest.

He was one of six persons cited by the party’s General Secretary, Mr Johnson Asiedu Nketia, as withdrawing from the December 20 congress of the party to elect its national executive.

Mr Didiaye, however, rejected the claim after his name and photograph were not included in the national organiser ballot.

The Deputy General Secretary of the NDC, Mr George Lawson, was reported to have said that the party took the decision against the plaintiff, because he failed to meet the requirements for filling of his forms.

After attempts to get the party to reverse the decision failed, Mr Didiaye resorted to the court to reverse the decision.

Time needed

When the case was called yesterday, counsel for the plaintiff, Mr Bright Obeng Manu, told the court that they had just received an affidavit in opposition from the defendant and needed time to study it.

The court, presided over by Mr Justice Anthony Oppong, was of the view that since the congress was slated for December 20, 2014, time was of essence and, therefore, adjourned the case to December 18, 2014 for hearing and determination.

The national delegates congress of the NDC comes off in Kumasi next Saturday, December 20.

More than 3,600 delegates of the party are expected to determine the fate of some 94 aspirants vying for 24 national positions.

The party has been dragged to court on a number of occasions which has resulted in injunctions placed on the congress. 

This is the second time it has had to be postponed after the original October 25 date had to be changed to December 13 as a result of a lawsuit filed against the party by an aggrieved member.
