Football administrator: A win for Palmer will provoke reforms’

An accomplished football administrator has boldly predicted the much-awaited Court of Arbitration of Sport (CAS) ruling on the Wilfred Kwaku Osei (Palmer) versus Ghana Football Association (GFA) case in favour of the plaintiff based on the merits vis-a-vis the FIFA Statutes.

The highly-respected soccer chief, who is well-versed in the rules of the game, told Graphic Sports that Mr Osei, know in football circles as Palmer, would prevail since his disqualification from the GFA Presidential election last October was unconstitutional.

Giving an insight into the FIFA Statutes, the source explained that the GFA could only sanction Tema Youth for not paying the 10 per cent to the association for the sale of Joseph Paintsil and not Palmer.

The source explained that, “Tema Youth is an entity associated with the GFA on its own bylaw and could never be attached to its owner Palmer in legal arguments.

“This is my candid opinion and I think Palmer has a strong case against the GFA. I am sure he will prevail in the ruling because the basis for his disqualification was unconstitutional."

“Tema Youth and Palmer are different entities in legal terms so it will be difficult to fault Palmer for wrongdoings at his club when you are talking about law,” the administrator stressed.

However, according to the source, a ruling on the matter could lead to so many reforms in the GFA Statutes, especially the illegal 10 per cent payment for International Transfer Certificate (ITC).

He further said a ruling in favour of Palmer would be a win for clubs since they would have the right to enjoy full transfer payments.

“It is going to be interesting in the coming days because a ruling in favour of Palmer would lead to a lot of reforms in the association.
