The Fast Track Division of the Accra High Court has adjourned to Friday, September 26, 2014, the hearing of the case in which two members of the New Patriotic Party (NPP) are seeking an injunction on the party’s National Delegates Congress to elect a flag bearer.
The plaintiffs, Rexford Adjei Frimpong and Oppong Kyekyeku, are contending that the fixing of October 18, 2014 for the congress is in contravention of the party’s constitution.
More time needed
When the case was called for hearing yesterday, counsel for the plaintiffs, Mr Eric Tieku, told the court, presided over by Mr Justice Mustapha Logoh, that he had just received the affidavit in opposition from the lawyers for the NPP and, therefore, needed time to study it.
The plaintiffs are seeking a declaration that upon a true and proper interpretation of Article 12A sub-section 2 of the NPP constitution, the October 18, 2014 date fixed by the National Council for the election of the party’s presidential candidate was in contravention of the said article.
They are also seeking a further declaration that by the provisions of the party’s constitution, the authority to issue notices inviting applications from members for nomination as candidates to contest the office of the President of the Republic of Ghana was the prerogative of the General Secretary.
A six-month period, they averred, should elapse between the issuance of the notice and the holding of the said election, pointing out that the period could not be varied by the national council of the party.
They are, therefore, seeking an order to set aside the October 18, 2014 date fixed by the national council.
They are further praying the court to issue an order directed against the national council to comply with the provisions of the NPP’s constitution and to fix a new date for the holding of the election of a flag bearer for the party.
