The President of the nine-member panel, Mr Justice William Atuguba, who disclosed this before proceedings began yesterday, however, did not make public the agenda for the meeting.

He informed the court that he had received correspondence from KPMG, which had been tasked to count the pink sheets that the petitioners made available to the court.

At the last time, the firm informed the court about the progress of work, only for it to be asked to use the pink sheets of the court’s President as a control mechanism.

Following the announcement by Mr Justice Atuguba, the court registrar furnished him with a letter from lawyers for the petitioners asking that the meeting be rescheduled for this morning.

Mr Tony Lithur, lead counsel for President Mahama, said postponing the meeting was quite inconvenient because there was no guarantee the meeting would end early enough for the day’s proceedings to progress.

Lead counsel for the Electoral Commission (EC), Mr James Quashie-Idun, also said the time scheduled for the meeting should be adhered to.

Mr Justice Paul Baffoe-Bonnie found out from Mr Addison what the main thrust of the letter was and whether it was the case that he wanted to be present at the meeting.

Mr Addison replied that at the time the letter was written, he did not know the judges had met in chambers over the matter and added that the petitioners would abide by the court’s order.

Mr Justice Jones Dotse said  Mr Addison should next time round try to consult with the other counsel in the matter before he wrote such a letter.
