Stop Trasacco from illegal development - Residents urge IGP

Mr Mohammed Ahmed Alhassan The East Legon Extension Developers and Residents Association has called on the Inspector General of Police (IGP) to stop Trasacco Estates Development Company Limited from continuing with the development of a portion of land at Mmai-Dzor.

According to the association, although Mr Ernesto Taricone, the Chief Executive Officer of Trasacco, and three others had been restrained by the Accra High Court from entering the land, Mr Taricone had defied the court’s order by his continued development of the land.

Making the call through the Daily Graphic in Accra,  Mr Kofi Owusu Agyeman, Secretary to the association, said the continued defiance of the court order by Mr Taricone would deny members of the association access to their properties.

He alleged that Mr Taricone had  hired land guards, who were terrorising people working on the properties of members of the association.

Mr Agyeman further alleged that although Mr Taricone had no title to that portion of land, he had been using the Adenta police to arbitrarily arrest people working on the properties of members.

The Accra High Court on May 14, 2013 granted an interlocutory injunction to restrain Ernesto Taricone and three others from entering certain portions of land the government had leased to the Nungua Stool at Mmai-Dzor in August, 2010.

The order followed a motion on notice filed by the Nungua Stool of Accra to restrain the defendants from entering the land in dispute or having anything to do with it pending the determination of the substantive suit.

The other defendants in the suit were Pamela Nkansah, Fiore Trust and the Lands Commission.

In the substantive suit, the plaintiff in the case was seeking a declaration that the consent to assignment dated June 20, 2011 purportedly executed by the Nungua Stool to Pamela Nkansah was a product of fraud and, therefore, null and void.

It was also seeking a declaration that both deeds of assignment dated January 5, 2011 from Pamela Nkansah to Fiore Trust and Taricone were fraudulent and, therefore, null and void.

The plaintiff is furthermore praying for an order directed at the Lands Commission to expunge from its records the consent assignment dated June 28, 2011 in favour of Pamela Nkansah.
