Two card-bearing members of the New Patriotic Party (NPP) have filed a suit at the Accra Fast Track High Court seeking an interlocutory injunction on the party’s October 18 congress.
The two , Rexford Agyei Frimpong and Oppong Kyekyeku, are also seeking from the court an order setting aside the October 18, 2014 date fixed by the National Council to elect the next flag bearer of the party for the 2016 general election, and declaring it null and void and of no legal effect.
The two are seeking a declaration that upon a true and proper interpretation of Article 12 A(2) of the NPP constitution, the 18th day of October 2014, fixed by the National Council for the election of the party’s presidential candidate is in contravention of the said article.
The two are further seeking an order against the National Council to comply with the provision of the NPP constitution and fix a new date for the election of presidential candidate
According to the two party members, holding of the election for the selection of the party’s presidential candidate is in breach of the party’s constitution.
‘’’ That by calculating six (6) months prior to the holding of the election for the selection of a presidential candidate from the date of June 6, 2014 when the General Secretary issued the notices to October 18, 2014, that period is certainly shorter than six months.
“That the six months cannot be varied by the National Council.’’ the two pointed out.
It will be recalled that five of the seven presidential aspirants on July 21, 2014 requested for review of the National Council decision on presidential candidate election dates.
The five are Mr Alan John Kwadwo Kyerematen, Mr Francis Addai Nimoh Mr Kofi Osei Ameyaw, Mr Stephen Asamoah Boateng and Dr Kofi Konadu Apraku.
They also said that ‘’upon the proper interpretation of Article 12 clauses one and two of the party’s constitution, the National Council decision violates the provisions of the constitution and cannot hold in law.’’
Meanwhile sources at the party head office said they were yet to receive the writ of summons and when they receive it they would act accordingly.
