Justice Dery ‘storms’ Kumasi to stop Anas video

The high expectation of residents of Kumasi who wanted to watch Anas’ exposé on the judiciary was yesterday dashed by a court injunction.

This followed an injunction application filed by lawyers of Justice Paul Uuter Dery at the Kumasi High Court on October 2, 2015, stopping the defendants from showing the video allegedly showing some high court judges and their lower court counterparts as well as some paralegal officers taking bribes to thwart justice.

Some of the residents that the Daily Graphic spoke to were disappointed and angry they were denied the opportunity to watch the video.

Golden Tulip was billed to show the video in two sessions yesterday but has been forced to call it off due to the writ.

Jointly included in the suit are Tiger Eye PI, the producers of the video, and Excellence In Broadcasting (EIB) Network, operators of Ultimate 106.9 FM, the promoters of the screening.

Claims

The plaintiff is asking the Kumasi High Court to perpetually restrain the defendants, their privies and assigns and whosoever from carrying out any public screening of the said “illegally and unlawfully procured audiovisual recordings at any time.”

It is also seeking a declaration that the intended public screening of the content of the audiovisual recording to the public by the first and second defendants at the third defendant’s facility (Golden Tulip) “is prejudicial to the plaintiff’s rights to a fair hearing.

Other reliefs sought included a perpetual injunction restraining the first and second defendants from publishing or causing to be published, the contents of the said illegally and unlawfully procured audiovisual recordings through any media platform, including social media.

Ultimate FM

The Programmes Manager of Ultimate FM, a member of EIB Network, Mr Frank Odoom, told the Daily Graphic that “we received the writ around 12.30 this afternoon and we want to respect the law”.

He appealed to the expectant patrons not to be worried about the development and assured them that once the case was moved in court on October 12, 2015, the legal stumbling block would be cleared.

He said immediately the way was cleared, the patrons would have access to the video.
