Court restrains Gomoa Fetteh chief, Central Regional Lands Commission
The High Court in Cape Coast has granted an interlocutory injunction against Nana Abor Yamoah II, the Chief of Gomoa Fetteh, and the Central Regional Lands Commission.

By the injunction, Nana Yamoah II, also known as Mr Eddie Acquaye, has been restrained and ordered by the court to stay away from the disputed lands in and around Gomoa Fetteh in the Gomoa East District in the Central Region.
The injunction application was filed by the Queenmother of Gomoa Fetteh, Obaahenba Amoasi Nkrabeah, on behalf of herself and also for and on behalf of the stool of Gomoa Fetteh.
The application for the interlocutory injunction was filed on her behalf by her Lawyer, Kofi Lamptey Nyarko Esquire of Adastra Chambers.
It was filed in the form of a motion on notice to the defendants but as of July 28, 2017 when the court gave its ruling, the defendants had not filed any response.
Following this development, the court granted the application for interlocutory injunction, thereby restraining the defendants and the Regional Lands Commission from dealing with the disputed lands in and around Gomoa Fetteh.
The injunction
“It is hereby ordered that the motion for interlocutory injunction is granted as prayed since the defendant had not reacted to the application served by the applicant since 19th July 2017,” the court stated in its order.
The court, presided over by Mr Justice Boampong, also ordered the first defendant, his agents, assigns, privies, workmen and servants to also stay away from the said disputed lands until the final determination of the case before it.
“It is further ordered that the first defendant, his agents, assigns, privies, workmen and servants are hereby restrained from having anything to do with the disputed lands, in other words, the first defendant is restrained from any further interference with the disputed lands until the final determination of the suit,” the court stated in its order.
Also restrained from dealing with the said disputed lands is the Central Regional Lands Commission.
“I further restrain the second defendant from entering into their records any grant from the first defendant in respect of the disputed lands,” the order by the court said.
The order for the interlocutory injunction was signed by both Justice Boampong, Justice of the High Court, and Francis K. Gedzeah, Registrar of the Court.
