“We have a better case than the PPP” – Hassan Ayariga

The All People's Congress (APC) flag bearer, Mr Hassan Ayariga has expressed confidence in winning the legal battle against the Electoral Commission (EC) regarding his disqualification from the December polls.

Clearly bolstered by the victory of another Presidential aspirant, Dr Papa Kwesi Nduom of the Progressive People's Party (PPP) against his disqualification, he says his confidence of winning was very high.

In an interview with the media after Monday's hearing of his case, Mr Ayariga said he was confident of winning because he thinks he has a better case than what Dr Nduom took to court.

"We have a better case than the PPP, we have properly filled the document but according to the EC, two of our subscribers signed for another political party".

In court

Meanwhile, the Accra High Court has adjourned the case to Tuesday for the legal teams of the APC and the EC to make their oral arguments.

At Monday's hearing the two parties informed the court that they failed to file their written submissions last Friday as ordered by the court.

They, therefore, pleaded with court and filed it today.

The court, presided by Ms Justice Barbara Tetteh-Charway will also fix the date for judgement at Tuesday's hearing.

Suit

Mr Ayariga dragged the EC to court after he was disqualified from contesting the upcoming election.

He claims the electoral body’s decision to disqualify him is not in “accordance with the law and procedure enshrined in C.I. 94”

He is seeking a declaration from the court that the EC’s decision to disqualify him without inviting him to make amends to his nomination “is premature in law, arbitrary, unreasonable, unlawful and a wrongful exercise of its administrative powers’’.

Also, he wants the court to declare that the EC has no power to disqualify him and even if it had the power, “its failure to adhere to due process was so unjust and perverted as to deprive the commission of its powers.’’

The APC founder, therefore, wants an order from the court that will compel the EC to accept his “nomination and nomination forms and to include his name on the ballot paper for the 2016 presidential election.’’
