Supreme Court throws out Ward-Brew

The Flag bearer of the Democratic People’s Party's (DPP) application praying the Supreme Court to postpone the December 7, 2016 presidential and parliamentary elections has been thrown out.

Mr Thomas Nuako Ward-Brew who had been been disqualified as a presidential candidate wanted the court to direct the Electoral Commission (EC) to allow him to effect the necessary correction on his nomination forms to enable him to contest the polls.

But in a unanimous decision Wednesday morning, the Supreme Court threw out his case, reports Graphic Online's Mabel Aku Baneseh.

According to the court, Mr Ward-Brew was out of time and that the matter had been disposed off on November 7th and that there was no way they can entertain him.

It also said in terms of procedure, he also made a lot of mistakes but the court decided to give him a hearing based on public interest.

Accordingly the case was dismissed for being without merit. Costs of Ghc3000 was awarded against Mr Ward-Brew.

Mr Ward-Brew, had told the court that the postponement would have given disqualified  presidential aspirants, including him, ample time to campaign.

He also prayed the Supreme Court to extend the period of time for the submission of nomination forms.

According to him, he was out of the jurisdiction when the Supreme Court, on November 7, 2017 extended the nomination period for disqualified aspirants, leading to the acceptance of four more presidential aspirants by the Electoral Commission (EC).
