Paul Afoko files appeal over suspension

Suspended Chairman of the New Patriotic Party (NPP), Mr Paul Afoko, has filed an appeal at the Court of Appeal for a review of the High Court's decision on his suspension.

The Human Rights Division of the Accra High Court on Tuesday, August 16, 2016 dismissed Mr Afoko’s suit challenging his suspension by the National Executive Committee (NEC) of the NPP on the grounds that he had no case.

The court, presided over by Mr Justice Anthony Yeboah, held that the procedure and processes that led to Mr Afoko’s suspension were “lawful, just and fair’’.

Following the court’s decision, Mr Afoko served notice that he would appeal the court’s ruling.

In a statement issued and signed by his spokesperson, Nana Yaw Osei on Monday, Mr Afoko indicated that his lawyers on Monday at 11:50am filed the appeal at the registry of the court.

The statement added that several grounds of appeal would be filed at the Court of Appeal.

Suit

Mr Afoko, in December 2015, dragged the NPP to court, claiming that his suspension was not in tandem with the party’s constitution.

He sought a declaration from the court that his indefinite suspension flouted the party’s constitution and was, therefore, unconstitutional.

He also wanted a declaration that he was the duly elected National Chairman of the party and, therefore, he ought to be accorded the privileges associated with that position.

Another relief sought by the suspended chairman was a declaration that the appointment of Mr Blay as acting National Chairman was unconstitutional and, therefore, null and void.

But the High Court in its ruling disagreed with him and said he had no case.
