Ayikoi Otoo leads Dr Nduom to court against EC

The Former Attorney General, Nii Ayikoi Otoo has taken up the disqualification case of Dr Papa Kwesi Nduom from the December 7 polls.

He would be representing Dr Nduom in court and has consequently filed a Motion for an order for judicial review in the nature of certiorari and prohibition.

Nii Otoo is leading Dr Nduom to the High Court to seek “an order of prohibition to restrain the EC from proceeding with balloting for position of presidential candidates for the 7th December elections."

They also want ”…a further order directed against the 1st Respondent [Mrs Charlotte Osei] in her capacity as Returning Officer for Presidential elections to grant the Applicant the opportunity to amend and alter the one anomaly found in his nomination papers as well as accept his nomination papers as amended or altered to enable him contest as a Presidential Candidate for the 7th December 2016 elections.”

Mr Ayikoi Otoo who was Attorney General in President John Kufuor’s administration is a member of the New Patriotic Party (NPP).

The Electoral Commission on Monday October 10th, 2016 announced the disqualification of Dr Nduom and 11 others from this year's presidential race.

It explained that it was unable to accept the nominations of Nduom, because the number of subscribers in his forms did not make the requirements of regulation 7(2) of CI 94 and that “one subscriber, Mr Richard Aseda, with voter ID number 7812003957 endorsed Dr Nduom’s forms in the Central region and again endorsed the same forms with the same ID number in the Volta region.”

On Friday, the Chronicle newspaper reported that Dr Nduom was to go to court with 18 lawyers but responding to the publication, Dr Nduom said a number of lawyers had come to his aid but would definitely not go to court with 18 as the publication stated.
